VMRD PRODUCT WARRANTY

Except to the extent otherwise provided herein, VMRD, INC. (“VMRD”) warrants each new Product manufactured and sold by VMRD, or one of its authorized Distributors, are as described in the quantity and contents stated on the label of such Product. NO OTHER WARRANTIES, EXPRESS OR IMPLIED, ARE MADE BEYOND THE LABEL DESCRIPTION, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. Products which have been changed or altered in any manner from their original design, or which are improperly or defectively installed, serviced or used are not covered by this warranty. VMRD’s obligations with respect to this warranty are limited to the replacement of the defective Product after VMRD’s inspection and verification of such defect or, at the option of VMRD, refund of the purchase price. All Products to be considered for replacement or refund are to be returned to VMRD after receiving authorization from VMRD. The buyer assumes all risk and liability whatsoever resulting from the use of said Products.

In no event shall VMRD be liable to purchaser for any indirect, special or consequential damages or lost profits, even if VMRD has been advised of the possibility thereof, and regardless of whether such Products are used singularly or as components in other Products. VMRD, Inc. is not liable for property damage, personal injury, or economic loss caused by the product. The information listed in any information sheet accompanying the Product is provided for reference only, and should not be substituted for the user’s own incoming material quality control.

The provisions of this warranty and limitation of liability may not be modified in any respect except in writing signed by a duly authorized officer of VMRD.

This warranty contains the complete and exclusive statement of VMRD’s obligations with respect to any of its Products.
